License and Support

ThistleKeep Engineering believes that this software will work in accordance with the expectations made in this document. In addition, TKE sponsors the Payback Challenge, to award customers who report problems and improvements for TruckTrek. However, the license agreement outlines the full legal extent of the sale of this software. Below, on this page, is a copy of the license agreed to during installation.

If you have questions about TruckTrek, or there is something within these Help pages that is unclear, send an e-mail to the address cited at the bottom of the page. TKE will strive to answer your questions promptly.

If you have any comment on TruckTrek or our other Punch! tools, feel free to write us at the e-mail address below. We will respond if appropriate and if higher priorities aren't too pressing.

This End-User License Agreement ("EULA") is a legal agreement between you (either an individual or a single entity) and ThistleKeep Engineering ("TKE") for the software product identified above ("SOFTWARE PRODUCT"). By installing or using the SOFTWARE PRODUCT, you agree to be bound by the terms of this EULA.

1. YOU MAY: TKE grants you the following rights:
   • One copy of the SOFTWARE PRODUCT may either be used by a single person who uses the software personally on one or more computers, or installed on a single workstation used non-simultaneously by multiple people, but not both.
2. YOU MAY NOT: You may not do any of the following:
   • Share, publish or distribute the SOFTWARE PRODUCT in any way.
   • Use a copy of the SOFTWARE PRODUCT that is not obtained from TKE or its resellers.
   • Modify, reverse engineer or disassemble the SOFTWARE PRODUCT in any way.
   • Use this SOFTWARE PRODUCT in any way to defeat any license restrictions on any other software.
3. TERMINATION. Without prejudice to any other rights, TKE may terminate this EULA if you fail to comply with the terms and conditions of this EULA. In such event, you'll need to remove any versions of the SOFTWARE PRODUCT from your computer(s) and destroy all copies of the SOFTWARE PRODUCT in your possession.
4. COPYRIGHT. All title, including but not limited to copyrights, in and to the SOFTWARE PRODUCT and any copies thereof are owned by TKE.
5. DISCLAIMER OF WARRANTY. THE SOFTWARE PRODUCT IS PROVIDED "AS IS" AND WITHOUT WARRANTIES AS TO PERFORMANCE OF MERCHANTABILITY OR ANY OTHER WARRANTIES WHETHER EXPRESSED OR IMPLIED. THE USER MUST ASSUME THE ENTIRE RISK OF USING THIS PROGRAM. To the maximum extent permitted by applicable law, in no event shall TKE or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or any other pecuniary loss) arising out of the use of or inability to use the SOFTWARE PRODUCT, even if TKE has been advised of the possibility of such damages.

Additional licensing terms for Special Editions of TruckTrek:

• Acquisition and use of a Special Edition is only allowed for an employee of the company that the special edition is targeted to. Any other use of a special edition is a violation of this license, and subject to the TERMINATION clause above. If employment with the company is terminated, then use of the Special Edition must cease, and that copy destroyed. The user is then allowed to use the General Edition originally purchased. Note the sanction above against using a copy of the software that is not obtained from TKE; the Special Edition may not be passed on to any other user.
• In acquiring a special edition, you will have your original copy of the General Edition of the SOFTWARE PRODUCT and the special edition. These are to be treated as a single copy of the SOFTWARE PRODUCT for the purposes of this license; they are not two separately licensed copies.

Additional licensing terms for modular subsets of TruckTrek:

• Acquisition and use of any module (subset) of the SOFTWARE PRODUCT shall be treated, for he purposes of licensure, as if it were the whole SOFTWARE PRODUCT.
